عظیم‌پی یک پلتفرم جایگزین برای پرداخت‌هاست که به ساکنان استرالیا این امکان رو می‌ده که پرداخت‌هاشون رو با ارزی غیر از دلار استرالیا (AUD) انجام بدن. از طریق این پلتفرم می‌تونید صورتحساب‌های BPAY رو پرداخت کنید و خریدهای حضوری یا آنلاین انجام بدین.
با موافقت با این شرایط و ضوابط، شما همچنین با شرایط پرداخت‌کننده BPAY که به‌صورت ارجاعی در این شرایط گنجانده شده، موافقت می‌کنید.
شرایط استفاده
سلب مسئولیت از بابت تضمین و نمایندگی
عظیم‌پی هیچ‌گونه تضمین یا نمایندگی صریح یا ضمنی‌ای در خصوص مناسب بودن سیستم عظیم‌پی برای نیازهای خاص یا شرایط ویژه مشتری ارائه نمی‌ده. ما هیچ تضمینی بابت کیفیت، در دسترس بودن، قانونی بودن، تحویل یا هر جنبه دیگه‌ای از خدمات ارائه نمی‌کنیم و تا جایی که قانون اجازه می‌ده، هرگونه مسئولیتی رو از خود سلب می‌کنیم.
محدودیت مسئولیت
شما تأیید می‌کنید که عظیم‌پی صرفاً یک سرویس ارائه می‌ده و اینکه محدود کردن بخشی از مسئولیت‌های ما، منطقی و رایج در چنین توافق‌نامه‌هایی هست.
بر این اساس، شما می‌پذیرید که عظیم‌پی در قبال موارد زیر مسئول نیست:
اگه ما یک اعتبارسنجی انجام بدیم ولی شرکت دریافت‌کننده (Biller) بهش عمل نکنه، به شرطی که این عدم اقدام از اشتباه یا کوتاهی ما نباشه؛
تأخیر یا عدم انجام تعهدات ما در صورتی که به‌خاطر اتفاقی غیرعادی و غیرقابل‌پیش‌بینی خارج از کنترل ما باشه و پیامدهاش با وجود تلاش‌هامون هم اجتناب‌ناپذیر بوده؛
پرداخت‌های اشتباه یا تکراری به‌خاطر اطلاعات نادرست BPAY که شما وارد کردین یا به دلیل فعالیت‌های تقلبی؛
هرگونه پیامد ناشی از پرداخت دیرهنگام صورتحساب‌ها. ما توصیه می‌کنیم که پرداخت‌ها دست‌کم ۳ روز کاری قبل از موعد سررسید انجام بشه تا زمان کافی برای پردازش بین‌مرزی وجود داشته باشه؛
هرگونه خسارت یا ضرری که عظیم‌پی به خاطر شکایت یا ادعایی که مستقیماً یا غیرمستقیم به خاطر رعایت نکردن تعهدات شما یا رفتار سهل‌انگارانه یا متقلبانه شما در این توافق‌نامه باشه، متحمل بشه.
به جز در موارد مرگ یا آسیب بدنی ناشی از سهل‌انگاری، مسئولیت عظیم‌پی در هیچ شرایطی از مبلغ پرداخت‌شده توسط شما بیشتر نخواهد بود.
برای شفاف‌سازی، مسئولیت حل اختلاف‌ها با مشتریان کاملاً بر عهده شرکت دریافت‌کننده (Biller) هست و اونا مسئول پاسخگویی به سؤالات، شکایات، بازپرداخت‌ها یا هرگونه پیگیری مشتری در رابطه با تراکنش انجام‌شده از طریق عظیم‌پی هستن.
اطلاعات شخصی
عظیم‌پی ممکنه اطلاعات شخصی شما رو جمع‌آوری، تأیید، نگهداری، استفاده و افشا کنه تا ثبت‌نام شما در سیستم عظیم‌پی رو انجام بده، سرویس رو به شما ارائه بده، به شرکت دریافت‌کننده کمک کنه تا وضعیت پرداخت‌ها رو بررسی کنه و شکایات رو پیگیری کنه. تمام این اطلاعات طبق سیاست حفظ حریم خصوصی ما مدیریت می‌شن.
شما موافقت می‌کنید که عظیم‌پی بتونه اطلاعات شما رو با شرکت‌های وابسته، ارائه‌دهندگان خدمات شخص ثالث و نهادهای نظارتی به اشتراک بذاره تا سرویس به درستی ارائه بشه و الزامات قانونی رعایت بشه.
همچنین ممکنه از شما اطلاعات بیشتری درباره پرداخت‌هایی که از طریق پلتفرم ما انجام دادین خواسته بشه. برای مثال، ممکنه از شما خواسته بشه نسخه اصلی قبض BPAY پرداخت‌شده رو برای تأیید ارائه بدین. در صورت عدم ارائه این مدارک، عظیم‌پی این حق رو داره که اون پرداخت رو لغو کنه.
موارد متفرقه
این توافق‌نامه طبق قوانین کشور استرالیا تنظیم و تفسیر می‌شه.
هیچ بخشی از این توافق‌نامه به نفع شخص ثالثی نیست، مگر اینکه صراحتاً ذکر شده باشه.
اگه هر بخشی از این قرارداد غیرقانونی یا غیرقابل اجرا تشخیص داده بشه، باقی بخش‌ها همچنان معتبر و قابل اجرا خواهند بود.
تأخیر یا عدم اقدام شما یا ما برای اعمال حقوق یا راه‌حل‌ها به معنی صرف‌نظر از اون‌ها نیست، مگر اینکه به‌صورت صریح اعلام شده باشه.
این توافق‌نامه تمام توافق‌های قبلی بین ما درباره سرویس عظیم‌پی رو لغو و جایگزین اون‌ها می‌شه.
کارمزدها
عظیم‌پی بابت هر تراکنش کارمزدی دریافت می‌کنه تا هزینه‌های عملیاتی و نگهداری پوشش داده بشه.
تسویه‌حساب‌ها
پرداخت‌های BPAY در روز کاری بعدی تسویه می‌شن.
چه اطلاعات شخصی‌ای از بازدیدکنندگان سایت جمع‌آوری می‌کنیم؟
کاربرانی که وارد حساب نمی‌شن: فقط اطلاعات تراکنش‌ها برای اهداف حسابداری جمع‌آوری می‌شه.
کاربرانی که وارد حساب می‌شن: اطلاعات پایه مثل نام، ایمیل تماس، شناسه کاربری و تاریخچه تراکنش نگهداری می‌شه.

Terms and Conditions
Introduction
AZIMPAY is an alternate payment solution platform that provides Australian residents with a non-AUD solution for payments. The platform allows customers to pay BPAY bills and make both instore and online purchases.
By agreeing to these terms and conditions, you are also agreeing to the BPAY Payer Terms which are incorporated into these terms and conditions by reference
Terms of Service
Exclusion of representation and warranties
AZIMPAY makes no warranty or representation, either express or implied, as to the suitability or fitness for the purpose of the AZIMPAY system in relation to any specific customer requirements, needs or particular circumstances. AZIMPAY gives no warranty, makes no representation and disclaims all liability so far as the law allows with respect to the quality, availability, legality, delivery or any other aspect of the service.
Limitation of liability
You acknowledge that AZIMPAY is solely providing a service and that some limitation of liability on AZIMPAY’ part is reasonable and customary in an Agreement such as this.
Accordingly, you agree that AZIMPAY shall not be liable for:
- Any validation provided by AZIMPAY not being acted upon by a Biller where the Biller’s failure to act does not result from our wrongful act or omission; or
- Any delay or failure to carry out AZIMPAY’ obligations under this Agreement arising from any abnormal and unforeseeable event outside our control where the consequences would have been unavoidable despite all our efforts to the contrary; or
- Any incorrect or duplicate payments made via AZIMPAY due to incorrect BPAY details provided by you, or fraudulent activities; or
- Any ramifications arising from overdue bill payments. All payments made using AZIMPAY should be made at least 3 business days before the BPAY bill due date to allow for cross border payment processing; or
- Any loss or damage suffered by AZIMPAY due to any claim, demand or action of any kind brought against AZIMPAY, arising directly or indirectly because you did not observe any of your obligations under the AZIMPAY Terms and Conditions or acted negligently or fraudulently under this agreement.
- Save in relation to death or personal injury caused by negligence, in no circumstances shall AZIMPAY’ liability hereunder exceed the value of the amount transacted by you.
- For the avoidance of doubt, the Biller is solely responsible for resolving all disputes with Customers and has sole responsibility for dealing with questions, complaints, refunds or enquiries raised by a Customer involving a transaction using the AZIMPAY Service.
Personal information
AZIMPAY may collect, verify, hold, use and disclose personal information about you to process your AZIMPAY registration, deliver the AZIMPAY service, assist your Biller with payment enquiries and deal with complaints. All personal information is handled in accordance with our Privacy Policy. You agree to allow AZIMPAY to disclose your personal information to AZIMPAY related entities, third party service providers and regulators for the purpose of providing the service to you and complying with regulatory requirements.
Furthermore, AZIMPAY may request further information from you in relation to the payments processed via our platform. For instance, we may request an original copy of the BPAY bill paid by you for verification purposes. Should this not be provided upon request, AZIMPAY reserves the right cancel such payment.
Miscellaneous
- This Agreement is governed by and construed in accordance with the laws of Australia.
- Nothing in this Agreement is intended to create any rights that are enforceable by any person who is not a party to this Agreement, unless otherwise stated.
- If any clause or part of any clause of this Agreement shall be found to be illegal or unenforceable, then the validity and enforceability of the remainder of the Agreement shall not be adversely affected.
- Any delay or failure by you or AZIMPAY to enforce or pursue any remedy or right hereunder shall not be deemed to be a waiver of that remedy or right and, unless we tell you otherwise in the case of AZIMPAY not exercising or enforcing a right or remedy, will not prevent that right or remedy from subsequently being exercised or enforced.
- This Agreement constitutes the entire agreement between us relating to the provision of the AZIMPAY service and supersedes any previous agreements and understandings between us relating thereto.
Fees
- AZIMPAY charges a fee per transaction to cover carry costs and operations.
Settlement
BPAY settlements are conducted the next business day.
What personal information do we collect from the people who visit our website?
Users who do not log in – We collect transaction information only for account-keeping purposes.
Users who log in – We hold basic contact information, user ID, Name, Contact email and transaction history.
